General Terms and Conditions – Grenzenlos by Airnomads

1. SUBJECT MATTER OF THE CONTRACT

1.1 PRELIMINARY REMARK

Paragliding is not a risky sport. When practiced responsibly, it is a safe and fascinating sport. We would like to encourage you—and at the same time expect—that you behave prudently and take personal responsibility. Please always take care not to endanger yourself, other participants, or bystanders during the course or trip, and not to hinder their activities. This includes, in particular, complying with all safety, health, and legal requirements.

1.2 REGULATION

The following General Terms and Conditions form the basis of the contractual relationship between you as a course/travel participant and Christina Siegl and/or Luis Fernando Jimenez Mejia, Grenzenlos by Airnomads, based in Fulda (Germany), hereinafter referred to as ‘Grenzenlos by Airnomads’.

2. CONCLUSION OF CONTRACT

The contract between you and Grenzenlos by Airnomads comes into effect as soon as your written registration via the Grenzenlos by Airnomads website is accepted without reservation. Your registration becomes binding upon dispatch of the written confirmation, and the rights and obligations arising from the contract (including these General Terms and Conditions of Contract and Travel) come into effect for both parties.

3. SERVICES

The services offered by Grenzenlos by Airnomads are described in the service description on the website and in the respective course and travel documents. Individual requests or deviating agreements shall only be effective if they are confirmed in writing and without reservation by Grenzenlos by Airnomads.

4. PRICES AND PAYMENT TERMS

4.1 PRICES

The prices of the trainings and the trips are shown on the website for each destination. Unless otherwise indicated, course/trip prices are per person in Euros.

4.2 LOYAL CUSTOMERS

All pilots receive the advertised loyal customer rate when booking their second course. Only applies to offers where the discount is advertised.

4.3 PAYMENT OF THE TRAVEL PRICE

Payment of the course/trip price is due no later than 15 days after receipt of the invoice. If payment is not made on time, Grenzenlos by Airnomads may refuse performance of the trip and assert processing fees.

4.4 SHORT-NOTICE BOOKINGS

If you book less than 30 days before the start of the course/trip, the full invoice amount is due immediately.

4.5 BOOKING FEES AND HANDLING CHARGES

Grenzenlos by Airnomads does not charge any booking or processing fees. However, for special requests that require considerable additional processing, a processing fee of up to €150 may be charged.

5. CHANGES/CANCELLATION OF THE COURSE/TRIP BY THE PARTICIPANT

If you cancel the course/trip or wish to change or rebook it, you must notify Grenzenlos by Airnomads personally and without delay.

If a course or trip is cancelled within the following periods prior to commencement, the following cancellation policies apply:

•    1–30 days prior to the start of the course or trip:

       The full course or trip fee is due; no refund is possible.

•    31–60 days before the start of the course or trip:

       A refund of 50% of the course or trip fee will be granted.

•    More than 60 days before the start of the course or trip:

A processing fee of €150 will be charged. The remaining amount will be refunded. If you re-register by the end of the following year, €100 of this processing fee will be credited towards the new course fee.

For bookings made more than 60 days before the start of the course/trip, there is a free right of withdrawal until the end of the fifth day after the booking date. After this period, the cancellation conditions listed above apply.

Cancellation insurance covering illness, accident, death, or force majeure is recommended and remains the customer’s responsibility.

In the offer no insurance is included. It is your responsibility to insure yourself against accidents, illness, rescue and repatriation. Grenzenlos by Airnomads strongly recommends comprehensive insurance cover (international health insurance, accident insurance, rescue and repatriation insurance, e.g. ADAC, ÖAMTC, REGA).

You must also have valid paraglider liability insurance that is valid for the destination country and covers at least €2,000,000 per claim.

6. PROGRAM AND PRICE CHANGES

Grenzenlos by Airnomads reserves the right to change descriptions and prices before the booking is completed. In exceptional cases, price increases may occur due to increased transport costs or government levies. If the price increase exceeds 10%, you have the right to withdraw from the contract and receive a full refund of the amount already paid.

As paragliding is a weather-dependent outdoor sport, Grenzenlos by Airnomads also reserves the right to adjust the itinerary, accommodation or means of transport of flying trips if necessary. In doing so, we always strive to provide equivalent services. For flying courses, the organiser also reserves the right to move the course location to another suitable flying area for organisational, safety or weather-related reasons.

7. TRIP CANCELLATION BY GRENZENLOS BY THE ORGANISER

Grenzenlos by Airnomads is entitled to cancel an event if there is a valid reason. In this case, the amount already paid will be refunded; any further claims, for example for accommodation or travel costs already booked, are excluded.

All courses and trips require a minimum number of participants. If this number is not reached, Grenzenlos by Airnomads may cancel the event up to 20 days before the start of the course or trip.

Cancellations may also be necessary due to force majeure, political events or unfavourable weather conditions. In such a case, you will be informed immediately. The organiser reserves the right to move the event to an alternative location. In this case, participants are entitled to a free rebooking.

8. CHANGES OR SERVICE FAILURES DURING THE COURSE/TRIP

Should changes be necessary during the course or trip, for example due to weather conditions, there is no entitlement to compensation. However, Grenzenlos by Airnomads endeavours to offer equivalent services, always giving priority to the safety of participants.

If a participant’s skills are insufficient, participation may be restricted for the safety of the group. In this case, the costs for alternative measures or arrangements shall be borne by the participant.

9. EARLY TERMINATION OF THE TRIP

If you end the course/trip early, no refund applies.

10. COMPLAINTS

If the trip deviates from the contractually agreed conditions or if damage occurs, the participant is obliged to report this immediately to the course or tour guide and demand remedial action. Any complaints must be submitted in writing within 30 days of return and supported by appropriate evidence.

11. DUTIES AND RESPONSIBILITIES

Participants are obliged to respect local regulations, rules and customs. Anyone who significantly disrupts the group or violates local norms may be excluded from the event without refund.

Good physical condition is required for participation. Unlicensed pilots must check all necessary permits themselves. If the requirements are not met, Grenzenlos by Airnomads may refuse participation without refund.

Participants are also responsible for ensuring that their equipment is safe and functional at all times. The absence of important equipment, such as a helmet or rescue parachute, may result in exclusion from the event without refund.

12. LIABILITY

Grenzenlos by Airnomads will only reimburse agreed services if no equivalent replacement could be offered on site.

Participation in paragliding is at your own risk. Grenzenlos by Airnomads accepts no liability for accidents, injuries or damage to health. You are responsible for complying with all applicable laws of the destination country.

Liability for simple negligence is excluded. It is the participant’s responsibility to carry a valid paragliding licence and airworthy equipment.   

13. IMAGE CREDIT/ DECLARATION OF CONSENT FOR USE OF PHOTOGRAPHS

I grant Grenzenlos by Airnomads permission to publish photographs of me taken by flight instructors, guides or other representatives on social networks and in online image galleries.

I may revoke this consent at any time, either verbally or in writing. If I do not consent to publication, I will inform the course instructor before the start of the event.
